Consumer Credit File Rights Under State and Federal Law
You have the right under the Fair Credit Reporting Act (FCRA) to request that credit reporting agencies maintain accurate and complete information in your credit file. Under federal law, a credit reporting agency must remove or correct information in your credit file that is inaccurate, incomplete, or unverifiable. Accurate information, however, may not be removed, even if it is negative. These rights exist regardless of whether you use a credit repair organization, and you may exercise them on your own, at no cost. You also have the right to dispute inaccurate information in your credit report directly with the credit reporting agency without the assistance of a third party.
Your Rights Under the Credit Repair Organizations Act (CROA)
Under federal law, you are entitled to the following rights:
- You may dispute inaccurate credit information yourself, without the assistance of a credit repair organization, at no cost.
- You may cancel any contract with a credit repair organization within three (3) business days of signing, without penalty or obligation.
- A credit repair organization may not charge you for services before those services are fully performed.
- A credit repair organization may not make misleading or untrue claims regarding the services it provides.
- A credit repair organization may not advise you to make false statements or misrepresent information to credit reporting agencies or creditors.
